Terms of Service

These Terms are a contract between you and Color A Picture, LLC ("we", "us"). By creating an account, buying credits, or using the service, you agree to them and to the Acceptable Use Policy, which is part of these Terms. The Privacy Policy explains how we handle your information. If you do not agree, do not use the service.
1. Who may use the service
- You must be 13 or older to create an account, and 18 or older to buy credits or a subscription.
- Color a Picture is a tool for teachers, parents and caregivers. Children may take part with you, but the account is yours, you are responsible for everything done with it, and children under 13 may not have their own accounts. If we learn an account belongs to someone under 13 we will close it.
- If you use the service for a school, you are responsible for complying with your school's or district's policies, including any requirement for parental permission before a student's photo is sent to an outside service. We do not act as a school official and these Terms do not bind your school.
- The service is offered in the United States. We block access from the European Union, European Economic Area and United Kingdom.
2. What the service does
You give us an image, or a short description, and we produce a black-and-white line drawing you can download and print.
The result is produced by AI, automatically, with no human review. AI systems make mistakes: details get dropped, distorted, or drawn wrongly, and a page made from a description may not be factually accurate. Look at every page before giving it to a child. You are responsible for reviewing what you print.
3. Credits, plans and payment
Pages cost credits. A conversion or a generated page costs 1 credit. A request that produces no page is not charged, and a request answered from our cache is not charged.
Kinds of credits and how they work:

Credits are spent in that order: free monthly, then Plus, then welcome and referral, then purchased, so the credits that would expire first are used first and purchased credits last.
Purchased credits. Purchased credits never expire and are yours to use at any time. They have no cash value, cannot be transferred, and are not redeemable for money.
Refunds. All purchases are final. Once a credit pack or subscription payment goes through we do not refund it, except where the payment was fraudulent or unauthorised, or in unusual cases at our discretion. If something has gone wrong, email hello@colorapicture.com and we will look at it. Nothing in these Terms limits any refund right you have under applicable law.
Free, welcome, referral and Plus credits are promotional, have no cash value, and are not refundable or transferable.
Price per page. If we ever change how many credits a page costs, we will give at least 30 days' notice by email before the change takes effect.
Plus subscription. Plus is a monthly subscription that renews automatically at the price shown at checkout until you cancel. You are charged on the day you subscribe and on the same day each month. Cancel at any time from your account page ("Manage subscription"); your plan keeps working until the end of the period you have paid for, and we do not refund part of a period. If a renewal payment fails, we will retry; if it still fails, your plan returns to free. If we change the Plus price we will tell you by email at least 30 days before the change takes effect, and you may cancel before then. The details of what you are agreeing to are shown before you confirm the purchase and repeated in your confirmation email.
Payment is handled by Stripe. We do not see or store card numbers.
Disputes. If you ask your bank or card issuer to reverse a payment, we remove the credits that payment bought (never below zero), cancel any Plus subscription paid by it, and pause free credits, referral rewards and new purchases on your account until the dispute is resolved. If the dispute is resolved in your favour, we restore the credits. Please contact us first: hello@colorapicture.com. We fix genuine problems, including by refund.
4. Your content
You are responsible for what you upload or describe. By uploading an image you confirm that you own it or have the right to use it this way, including the right to send it to the AI providers named in the Privacy Policy. We do not choose your inputs and do not review them before conversion, beyond automated safety checks.
Licence to us. You keep ownership of what you upload. You give us only the limited, non-exclusive licence needed to run the service: to process your image or description, to send it to the providers who perform safety checks and conversion, to hold the result in our 7-day cache and, if you are signed in, in your library until you delete it, and to generate a short description of the finished page for your own library search. This licence does not include training AI models, advertising, or publishing your content, and it ends when the content is deleted.
Pages made from your image. You may do anything you like with a page we produce from your image, including selling it. We claim no rights in it. Two limits on what we can promise: (1) our permission says nothing about the rights of whoever owns what you uploaded — converting someone else's photograph, character or artwork does not make the result yours to sell; and (2) we do not warrant that a machine-produced page is protected by copyright in any country, and you should not rely on these Terms as advice that you own a copyright in it.
Pages made from a description. We generate these from your words. We grant you all rights we have in the result, for any purpose, and claim none ourselves. We screen descriptions for named characters and brands and refuse those requests; even so, a generated page may resemble something that is protected, and we do not warrant that it does not. Review a page before using it commercially.
We do not publish your pages. Pages are not posted to a public gallery, not indexed by search engines, and not shared with other users. Our sample gallery is made only from our own descriptions.
Copyright complaints are handled under our DMCA Policy.
5. Acceptable use
The Acceptable Use Policy is part of these Terms. In short: use the service to make coloring pages; do not upload sexual content of any kind, images of people who have not agreed to it, or material you have no right to use; and do not circumvent limits or resell access.
6. AI-generated content
Every page is made by an AI model. Pages are labelled as AI-generated on screen; downloaded files carry no hidden marking. Descriptions you type are checked by automated systems before anything is drawn. We may refuse any request, and a refused request is not charged.
7. Deleting your account
You can delete your account from the account page. It is deactivated immediately and finally deleted after a 30-day grace period, during which you can restore it from the link we email you.
When deletion is final: your saved pages, email, name, problem reports and support attachments are deleted; your usage records are stripped of identifiers; and your credit ledger is anonymised and kept as a financial record (see the Privacy Policy). All remaining credits, including purchased credits, are forfeited when deletion is final and are not refunded — the account page tells you the exact number before you confirm, and you can restore the account, with its credits, at any time during the 30-day grace period. An active Plus subscription should be cancelled before you delete; deletion does not by itself stop a renewal already scheduled, so cancel first or contact us.
8. Our rights
We may suspend or close an account that breaks these Terms or the Acceptable Use Policy, and may remove content. If we close your account for a breach, all remaining credits are forfeited. We may change or discontinue the service; if we discontinue it we will give at least 30 days' notice so you can use your remaining credits, and we will refund unused purchased credits at the price paid.
9. Disclaimers
THE SERVICE AND EVERY PAGE IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT A CONVERSION WILL SUCCEED, THAT A PAGE WILL BE ACCURATE, APPROPRIATE OR FREE OF OTHERS' RIGHTS, OR THAT THE SERVICE WILL BE AVAILABLE OR ERROR-FREE. TO THE EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow these disclaimers, so they may not apply to you.
10. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF ONE HUNDRED US DOLLARS OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. These limits do not apply to liability that cannot be limited by law, including for our fraud, gross negligence or wilful misconduct, and nothing in these Terms limits rights you have as a consumer under applicable law.
11. Indemnity
You agree to defend and indemnify us against claims by third parties that arise from your uploads or descriptions, or from your breach of these Terms, to the extent permitted by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, and you consent to their jurisdiction, except that either of us may bring a claim in small-claims court where it qualifies. These Terms do not require arbitration and do not waive your right to bring a class action.
13. Changes to these Terms
We may update these Terms. For a material change we will email account holders at least 14 days before it takes effect (and, for Plus subscribers, before the next renewal it affects). Continued use after the effective date is acceptance; if you do not agree, stop using the service.
14. General
If any part of these Terms is unenforceable the rest remains in effect. You may not transfer your account. These Terms, the Acceptable Use Policy, the DMCA Policy and the Privacy Policy are the entire agreement between us about the service.
